Understanding LMIA-Based Work Permits Under the Temporary Foreign Worker Program (TFWP)

If it’s your dream to work in Canada through the Temporary Foreign Worker Program (TFWP), it’s very important for you to understand how an LMIA (Labour Market Impact Assessment) affects your work permit or is related to it. Many candidates have the misconception that the LMIA’s validity decides the duration of their work authorization, but that’s not entirely the case.

Let’s dive into the blog to learn about the factors which affects the work permit authorization and other important points such as the difference between LMIA validity and work permit duration, etc.

LMIA Validity vs. Work Permit Duration: What’s the Difference?

A common misunderstanding is that the LMIA’s validity window decides the length of time a foreign candidate can work and stay in Canada. Your work permit’s duration is not directly linked to the LMIA’s validity.

    Here’s how it works:

A Step-by-Step Look at the LMIA-Based Work Permit Process

Let’s walk through the entire timeline using a fictional example to better understand the whole process of how a Canadian employer might hire an international candidate for work under the TFWP process.

For example, let’s take a Canadian car manufacturer who wants to hire a mechanical engineer from a foreign nation to be employed at their Ontario plant.

    Employer Applies for an LMIA

To begin the process, the company applies for an LMIA application to ESDC, before the planned start date of employment. For instance, they applied on July 30, 2025, for a planned start on December 1, 2025.

LMIA Approval with Work Duration Recommendation

On September 19, 2025, the company or the employer gets a positive LMIA with a recommended work window of 1 year. The LMIA stays valid until March 19, 2026.

Worker Applies for a Work Permit

The employer shares the LMIA with the selected foreign engineer candidate, who then applies for a work permit application to IRCC on September 30, 2025.

    IRCC Issues the Work Permit

Upon approval, the foreign candidate might receive a work permit valid from December 18, 2025, to January 30, 2027. This allows them over a year of authorized employment opportunity in Canada. The extended period mostly goes to travel or relocation.

Applying for an Extension (if needed)

In case both the worker and employer want to continue the employment further, the employer or company should apply for the extension of the worker’s LMIT before the current one expires. The ideal time is 30 days before the expiration of the current work permit.

Maintaining Your Right to Work in Canada

The employer must submit the work permit extension application before the current one expires for the worker to keep their maintained status in Canada. This action will help the worker to continue working under the same rules and conditions such as employer, location, and job, while waiting for the IRCC to extend the permit.

How to Get an LMIA: What Employers Need to Know

An LMIA is nothing but a test or assessment by the ESDC which helps the unit decide that there is no Canadian or Permanent Resident available to fill the job opportunity. Hence, a foreign worker needs to be hired for the same. And below are the steps how the employers can obtain an LMIA:

    LMIA Application Process:

Step 1: Submit Application to ESDC

Employers or the company should first open the job in Canada by advertising through various portals and make genuine efforts to recruit domestically. This should be for four weeks at least. They also have to provide details about job duties, wages, and employment conditions, along with the required processing fee.

Step 2: Wait for the LMIA Decision

If the assessment by ESDC comes positive, a positive LMIA is sent to the employer with a recommended work duration.

Step 3: Share LMIA with the Worker

After the employer gets the LMIA, it is shared with the selected foreign worker to help with their work permit application to IRCC.

Applying for a Work Permit After Receiving the LMIA

The foreign candidate must apply for a closed work permit linked to the specific employer and job mentioned in the LMIA. The candidate’s application must also include:

Note: A TFWP work permit is specific to the employer. If the worker wants to switch jobs or employers, they must apply for a new permit.

Timeline Clarifications: LMIA Validity vs. Work Start Date

While the job can start after the LMIA expires, what’s important is that the work permit application for extension is applied before the LMIA’s current validity ends. The expected work start date must be clearly mentioned in the LMIA application to assist ESDC and IRCC assess the right work duration.

LMIA Processing Times (as of June 2025)

The processing time for an LMIA result differs depending on the stream or pathway under which the employer applies. Here’s a table of the present processing times:
LMIA Stream Average Time (Business Days)
    Global Talent Stream 9
    Agricultural Stream 14
    Seasonal Agricultural Worker Program 8
    High-Wage Stream 41
    Low-Wage Stream 45
    Permanent Resident Stream 240

    Submit Your Application

Before finalizing your application, make sure you have:
Applications without any needed elements will be rejected or delayed. If you get a request for further papers, you have 30 days to produce them.

    What Happens Following Submission?

Upon receipt of your application, IRCC will begin the evaluation process and require additional documentation, including:

    Medical exams

You will be called with directions on where and how to take a medical checkup.

    Police Certificates

Applicants over the age of 18 may be required to present police clearance certificates. These papers have to be valid for one year after the date of issuance.

    Biometrics

Applicants aged 14-79 must submit fingerprints and a picture. This phase must be completed within 30 days of getting the biometric instruction letter.
If delays occur, you might ask for an extension using the IRCC’s web form.

    Final Thoughts

It could be quite overwhelming and complex to navigate the LMIA and work permit process under the TFWP, along with finding the right work opportunity. But understanding the timeline and responsibilities is the key to planning it better. Remember, the LMIA is just the first step.
The key factor for the duration of a foreign worker’s stay in Canada is the duration of the work permit issued by IRCC, not the LMIA itself.
